These Terms & Conditions (“Terms”) set out the rules and conditions that apply when you access or use the Carlective website, mobile application, digital services, community features, and any related services provided by Carlective (collectively, the “Platform”).

By creating an account, accessing the Platform, uploading information, or using any Carlective service, you agree to be legally bound by these Terms.

1. About Carlective

• Create personal Digital Garages.

• Create and manage Vehicle Passports.

• Store and organise vehicle-related information.

• Share automotive content.

• Connect with other enthusiasts.

• Participate in automotive communities and future services.

Carlective’s purpose is to create a trusted ecosystem around vehicle ownership, enthusiast culture, and automotive experiences. Carlective does not currently act as:

• A vehicle manufacturer.

• A vehicle dealer.

• A vehicle inspection authority.

• An insurance provider.

• A finance provider.

• A valuation service.

• A legal certification body.

Information displayed on Carlective is provided by users, third-party providers, or generated through Platform features. Users should carry out their own checks and professional assessments before making decisions relating to vehicles, purchases, ownership, finance, insurance, or safety.

2. Future Development of the Platform

Carlective is designed to evolve over time. Future features may include:

• Vehicle marketplaces.

• Vehicle sharing or booking functionality.

• Vehicle inspections.

• Maintenance records.

• Specialist partner services.

• Member benefits.

• Dealer partnerships.

Carlective may introduce, modify, test, restrict, or discontinue features at any time. Where future services involve additional terms, agreements, fees, or requirements, users may be required to accept additional conditions before accessing those services.

3. Definitions

For the purposes of these Terms:

“Carlective”, “we”, “us”, or “our”

Means Carlective and the company operating the Platform.

Means any individual who accesses, registers with, or uses the Platform.

“User Content”

Means any information, images, videos, documents, text, comments, reviews, records, or other material uploaded, submitted, or shared by a user.

“Community Features”

Means any social, communication, discussion, networking, review, or interaction features provided by Carlective.

“Future Features”

Means any products, services, tools, or functionality that Carlective may introduce in the future.

“Platform”

Means the Carlective website, applications, software, services, and related technology.

4. Eligibility to Use Carlective

To create an account and use Carlective, you must:

7. Digital Garages

A Digital Garage allows users to create a personalised automotive profile.

Users may use their Digital Garage to:

• Maintain digital records.

Users acknowledge that a Digital Garage:

• Is a digital organisational tool.

• Does not replace official government records.

• Does not replace registration documents.

• Does not prove legal ownership.

• Does not guarantee vehicle condition or history.

Users are responsible for ensuring information added to their Digital Garage is accurate.

8. Vehicle Passports

Vehicle Passports are designed to create a structured digital history of vehicles. A Vehicle Passport may contain:

• Vehicle specifications.

• Maintenance records.

• Service history.

• Repair information.

• Modification details.

• Photographs.

• Ownership milestones.

• Inspection information.

• Other relevant automotive information.

The purpose of the Vehicle Passport is to help users organise and present vehicle information in a convenient format. A Vehicle Passport is not:

• A government-issued document.

• A legal title document.

• A replacement for HPI checks or equivalent vehicle history checks.

• A professional inspection report.

• A guarantee of vehicle condition.

Users must not misrepresent a Vehicle Passport as an official certification or verification unless expressly provided by Carlective through a specific service.

9. Accuracy of Vehicle Information

Users are responsible for ensuring that information uploaded to Carlective is accurate, current, and not misleading.

Users must not:

• Create false vehicle histories.
• Misrepresent ownership.
• Upload inaccurate service records.
• Claim modifications that have not occurred.
• Mislead other members.

Where Carlective becomes aware of inaccurate or misleading information, we may remove, restrict, or modify access to that content.

10. User Content

Users retain ownership of the content they upload to Carlective. By submitting User Content, you grant Carlective a worldwide, non-exclusive, royalty-free licence to use, store, reproduce, display, and distribute that content for purposes including:

• Providing Platform functionality.
• Displaying Digital Garages and Vehicle Passports.
• Improving Carlective services.
• Developing new features.
• Promoting the Carlective community.

This licence does not transfer ownership of your content to Carlective. You remain responsible for ensuring you have the necessary rights to upload any content. You must not upload content that:

• Infringes another person’s intellectual property rights.
• Contains unlawful material.
• Violates privacy rights.
• Contains misleading information.
• Harms another person or organisation.

Carlective may remove content that breaches these Terms.

11. Data Protection & Privacy (UK GDPR)

Carlective processes personal information in accordance with applicable UK data protection laws, including:

• The UK General Data Protection Regulation (UK GDPR).

• The Data Protection Act 2018.

Carlective may collect and process personal information for purposes including:

• Creating and managing accounts.

• Providing Digital Garage functionality.

• Developing and improving Carlective services.

Carlective will process personal data lawfully, fairly, and transparently. Users have rights under applicable data protection laws, including the right to:

• Respect other users, their vehicles, and their property.

• Avoid behaviour that damages trust within the platform.

Users must not:

• Harass, threaten, intimidate, or abuse other members.
• Engage in discriminatory behaviour.
• Create misleading vehicle profiles.
• Impersonate another person, business, or organisation.
• Upload fraudulent documents or information.
• Use Carlective for illegal activities.

• Attempt to manipulate reviews, ratings, verification systems, or community reputation features.

Carlective exists to support genuine automotive enthusiasm. Users who undermine the safety, trust, or reputation of the community may have their access restricted or removed.

13. Prohibited Activities

Users must not use Carlective to:

• Conduct unlawful activities.
• Upload malicious software or harmful code.
• Attempt to access restricted areas of the Platform.
• Scrape, copy, or extract Platform data without permission.
• Reverse engineer, modify, or interfere with Carlective technology.

Users should complete appropriate checks before purchasing, selling, insuring, financing, or relying on vehicle information.

22. Limitation of Liability

Nothing in these Terms excludes or limits liability where it would be unlawful to do so under UK law.

This includes liability for:

• Death or personal injury caused by negligence.

• Fraud or fraudulent misrepresentation.

• Other rights that cannot legally be excluded.

Subject to the above, Carlective shall not be responsible for losses arising from:

• User-generated content.

• Interactions between users.

• Temporary Platform unavailability.

Carlective provides a digital platform and does not guarantee the actions, reliability, honesty, or performance of individual users.

Nothing in these Terms affects rights that cannot legally be excluded or limited.

Carlective may transfer its rights and obligations as part of a business restructure, acquisition, merger, or sale.
